XPets User Agreement

Welcome to XPets, a social media mobile application dedicated to pet lovers! By using our platform, you agree to abide by the terms and conditions outlined in this User Agreement ("Agreement"). Please read this Agreement carefully before using XPets. If you do not agree to these terms, please do not use our services. 

1. Acceptance of Terms 

By creating an account or otherwise using XPets, you accept and agree to be bound by this Agreement and our Privacy Policy, which is incorporated into this Agreement by reference. If you do not agree to these terms, you should not use XPets. 

2. Eligibility 

XPets is intended for users who are 13 years of age or older. By using XPets, you represent and warrant that you are at least 13 years old. If you are under the age of 18, you may use XPets only with the consent of your parent or legal guardian. 

3. Account Registration 

To use XPets, you must register and create an account. You agree to: 

• Provide accurate, current, and complete information during the registration process. 

• Maintain and promptly update your account information to keep it accurate, current, and complete. 

• Keep your password secure and confidential. 

• Notify XPets immediately of any unauthorized use of your account or any other breach of security. 

4. User Conduct 

As a condition of using XPets, you agree not to: 

• Use XPets for any illegal or unauthorized purpose. 

• Post, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. 

• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. 

• Use XPets to collect or store personal data about other users without their express permission. 

• Interfere with or disrupt the XPets platform, servers, or networks connected to XPets. 

• Engage in any form of automated data collection, including but not limited to, harvesting, scraping, or using bots. 

5. Content and Ownership 

You retain all rights in any content you post, upload, or share on XPets ("User Content"). By posting User Content, you grant XPets a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, display, reproduce, modify, publish, distribute, and create derivative works of such content in connection with XPets. You represent and warrant that you own or have the necessary rights to post your User Content on XPets and that your User Content does not infringe or violate the rights of any third party. 

6. Intellectual Property Rights 

XPets and its original content, features, and functionality are and will remain the exclusive property of XPets and its licensors. The XPets name, logo, and other XPets trademarks, service marks, graphics, and logos used in connection with XPets are trademarks or registered trademarks of XPets. Other trademarks, service marks, graphics, and logos used in connection with XPets may be the trademarks of their respective owners. Your use of XPets does not grant you any right or license to reproduce or otherwise use any XPets or third-party trademarks. 

7. Privacy 

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use XPets. By using XPets, you consent to the collection and use of information as outlined in the Privacy Policy. 

8. Termination 

XPets reserves the right, in its sole discretion, to terminate your access to all or part of XPets, with or without notice, for any reason, including, without limitation, breach of this Agreement. 

9. Disclaimer of Warranties 

XPets is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. XPets does not warrant that the platform will be uninterrupted, secure, or error-free, or that any defects or errors will be corrected. 

10. Limitation of Liability 

To the fullest extent permitted by law, XPets shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use XPets; (b) any content obtained from XPets; or (c) unauthorized access, use, or alteration of your transmissions or content. 

11. Indemnification 

You agree to indemnify, defend, and hold harmless XPets, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use or misuse of XPets, violation of this Agreement, or infringement by you or any third party using your account, of any intellectual property or other right of any person or entity. 

12. Changes to This Agreement 

XPets reserves the right to modify this Agreement at any time. We will provide notice of changes by posting the updated Agreement on XPets and updating the "Last Updated" date. Your continued use  of XPets following any such changes constitutes your acceptance of the new Agreement. If you do not agree to any of these terms, you are prohibited from using or accessing XPets. 

13. Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within [Insert Jurisdiction] for the purpose of litigating all such claims or disputes. 

14. Miscellaneous 

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of XPets to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
